Explore Active Tours and Adventures is a company founded by a native Tanzanian with over nine years of experience in the tourism industry. Our founder started as a porter and progressed to becoming a professional tour guide before establishing this company. This extensive experience provides us with a great understanding of the intricacies of tourist activities and the local community's importance in these areas. Our commitment to creating employment opportunities for the youth in our region is at the forefront of our business. With a highly experienced team across all units of our workforce, we are well-equipped to anticipate and overcome any challenges that may arise during your trip. When the terms and conditions apply

The relationship between the Client and Explore Active shall be governed by these Terms and Conditions. These Terms and Conditions shall apply in the following situations:

  • When you book a trip directly with us
  • When you book a trip through our partners acting as our sales representatives
By booking a trip with us directly or through one of our partners, such as travel agencies and marketplaces, both parties agree to be bound by these Terms and Conditions. These Terms and Conditions detail the rights and responsibilities you have when booking and participating in our tours in Tanzania. Please keep in mind that these terms govern your interactions with us.

Our warranties and representations

We warrant and represent that:

  • All our Kilimanjaro guides, wildlife safari driver-guides and consultants have professional training in their respective fields
  • We stand behind the accuracy and truthfulness of all the information we use in our marketing and advertising efforts. We do not employ any form of exaggeration or misrepresentation when describing our products to our customers.
  • We also warrant and represent that your trip with Explore Active will positively impact the developing communities of Tanzania
We are dedicated to promoting eco-friendliness and implementing rigorous protocols to foster sustainable tourism in Tanzania while preserving its natural heritage for future generations.

Treatment of your personal information

To ensure smooth expedition arrangements, we will need certain personal information from you, such as your full name, age, nationality, passport information, dietary preferences, and medical details. Some of this information will be shared with the administration of Tanzania's wildlife areas to process entry permits, and with accommodation providers to ensure a comfortable stay during your expedition.

Communications and correspondence

To prevent falling victim to travel scams, please make sure to communicate with us only through the following channels:

  • Phone and WhatsApp: all phone numbers published on Explore Active website
  • Other means of communication: online-chat on our website
Our proactive communication security policies have ensured that our company has not experienced any incidents of malicious third parties impersonating or misrepresenting us for their own gain. Nevertheless, it is always prudent to exercise caution. If you suspect that someone you are communicating with is not a legitimate representative of Explore Active, please contact our founder, Amos, at ceo@exploreactive.com.

Booking and payment process

To start the booking process, you can reach out to our offices by phone or email. A dedicated travel consultant will be assigned to handle all your communication and plan and organize your tour down to the smallest detail. Once you agree on all the specifics, we will issue an invoice allowing you to make a deposit and confirm your booking. Your adventure will be considered confirmed as soon as the deposit payment reaches our account, which our designated travel consultant will immediately notify you of. Depending on the type of tour, our consultant will set the deadline for the deposit payment. The full payment for your tour must be made 14 days before the scheduled start date unless agreed otherwise in writing with our consultant. Regardless, all our travel packages must be fully prepaid. Timely payments are crucial since these funds are used to cover hotel reservations and other expenses related to your tour, which are usually prepaid in Tanzania. Failure to make timely payments without prior notice or arrangements with our company may result in the cancellation of your booking, and any deposit made may be forfeited according to our cancellation policies. Please note that all transaction-related charges for your payments must be covered by you. When using wire transfers, both the sender and receiver banking commissions must be covered by you. A 3.5% surcharge will apply to all credit card payments. If the deposit and final payments made to our accounts are incomplete for any reason, we will charge you for the missing amount upon your arrival in Tanzania. Participation of minors

  • It is the policy of Explore Active that individuals who are under 18 years of age must have their bookings made by their parents, guardians, or legal custodians. By making a booking for a minor, the parents, guardians, or legal custodians accept and agree to abide by the company's Terms and Conditions, which include the assumption of risk and limitations of liability. This policy is in place to ensure the safety and well-being of minors who participate in Explore Active's wildlife adventures.
  • At Explore Active, we require that minors are accompanied and supervised by an adult client throughout their participation in our wildlife adventures. The client will be held responsible for ensuring that the minor behaves appropriately, and will be liable for any damages that may result from their conduct. While we take extra care to ensure the safety and comfort of children travelling with us, we do not provide child care or chaperoning services.
  • Before confirming a booking made on behalf of a minor, we will carefully evaluate the request and make a final decision based on our approval. The adult accompanying the minor will be solely responsible for obtaining the necessary permits, approvals, and fulfilling any other legal requirements that may be required for the minor to travel to Tanzania. We will not be held liable for any failure to comply with these requirements that may result in the minor's inability to enter Tanzania.
Third-party bookings (tour leaders, travel agencies and other travel professionals) If you are making a booking on behalf of others as a tour leader, travel agent, or similar role, you will be considered the primary contact person for all the participants on the tour. As such, you will be held responsible for:
  • Informing the other tour participants of these Terms and Conditions. If you consent to them, we will assume that you have secured express consent of all tour participants to these Terms and Conditions and to the inclusions and exclusions of the tour package.
  • Completing the payments timely and accurately.
  • Passing all relevant information to the tour participants in a comprehensive and timely manner. If there are any agreed changes with regard to the dates or itinerary, you will be responsible for informing the tour participants and securing their consent.
  • Providing correct and accurate information about the tour participants in a comprehensive and timely manner. It is your responsibility to collect such information and ensure its correctness and accuracy. Under no circumstances will we be liable for any errors and omissions in such information
Should you be unwilling to assume responsibility for the aforementioned obligations, then each member of the group must communicate with us individually and make their own bookings.

Prices

Once we confirm your booking, the price will not be changed, except for the unlikely case of the government of Tanzania increasing park fees, taxes or other tourism-related payments. In such a case, a copy of the relevant public notice shall be made available to you immediately. Two options shall be available to you in case of price increase:

  • To cancel your tour and receive a refund in accordance with our cancellation policies.
  • To agree to the change of price and pay the difference to us.

Changes to the itinerary

Changes by the Client

  • Any changes you make to your itinerary will be made free of charge if they do not result in extra costs for us. Any such costs must be covered by the Client.
  • If you decide to discontinue our tour after it stated, either voluntarily or involuntarily, you will be liable to cover any extra costs caused by your decision to leave the trip. Such costs may include but are not limited to covering transportation and accommodation expenses.
  • If you miss any tour service, sightseeing or meal, or fail to use any other service acting on your own account, no refund will be provided.
Changes by the Company
  • While we do our best to ensure that your tour goes as planned, situations may arise (e.g. parts of the planned route becoming inaccessible due to poor weather conditions) requiring us to change your itinerary. Though rare, such cases are not to be ruled out and we shall endeavour to inform you of them promptly.
Changes because of third parties
  • The Company shall not be liable for any delay, disruption, damage or loss outside of our reasonable control. These may include - but are not limited to - third-party actions, flight delays and any events of a force majeure nature.
  • You or your insurance company will be liable to cover any expenses, such as extra accommodation and transportation expenses, caused by such change or disruption

Changes to travel dates

In the event that you decide to alter your travel dates after making payments, it is mandatory to notify us of these changes at least 60 days prior to the original start date of your tour. Please be advised that any new proposed dates must fall within a year of your original travel dates. Furthermore, it is essential to note that Tanzanian domestic carriers do not facilitate rescheduling of flights, and hotels and lodges may impose penalties on booking date changes, as well as increase accommodation prices based on season and availability. In such cases, you shall be held responsible for any additional costs that arise, and it will be necessary to cover these expenses.

Cancellations

Cancellation by the Client In case of cancelation, lodges and airlines charge penalty fees. To cover those penalties, the following cancelation fees are to be deducted from the deposit amount:

  • 100 USD per person deposit is non-refundable regardless of the date of cancelation, though transferable to any other dates.
  • 10% cancelation fee if canceled more than 90 days before tour start.
  • 30% cancelation fee if canceled 60-89 days before tour start.
  • 60% cancelation fee if canceled 30-59 days before tour start.
  • 80% cancelation fee if canceled 8-29 days before tour start.
  • No refund if canceled 0-7 days before tour start
Please take note: if the penalty fees charged by lodges and airlines surpass the percentages indicated above, the non-refundable amount shall be correspondingly increased. Bank commissions for returning the funds to your account shall be subtracted from the refund. When rescheduling the tour rather than canceling it, the lodges and airlines included in your booking are more likely to offer a deferral without penalty. In the event of a no-penalty deferral, we will make every effort to reschedule your entire tour to new dates without any changes. However, the decision to allow a no-penalty deferral rests solely with the lodges and airlines under the booking, as they have the contractual right to charge penalties irrespective of the circumstances of cancellation. We strongly advise obtaining insurance with sufficient coverage for tour cancellation to cover all potential contingencies. In the event of any unforeseen circumstances, such as illness or flight cancellation, you can claim financial losses from your insurance company. We will provide the necessary documentation for all the expenses you have incurred. Cancellation by us
  • In the unlikely event of us cancelling your tour for any reason, a 100% refund of any payments already made by you to us shall follow.

Travel documents, visa, and entry to Tanzania

You should make sure that all your travel documents are in place. It is important to ensure that your passport remains valid for at least six months after entering Tanzania. Additionally, there should be at least two blank pages for visa and stamps. Obtaining a visa for entry into Tanzania is also required, and applying online through the Tanzania Immigration Department's website is the most convenient and efficient method. Please note that while we provide visa-related tips, our recommendations are not comprehensive. The information on our website is for general knowledge only, and we suggest contacting the Embassy of the United Republic of Tanzania for the latest updates. We cannot guarantee the accuracy or completeness of the information published on our website regarding visas, vaccinations, or other entry requirements. You are responsible for covering all visa and entry-related costs. In the unlikely event that you are denied entry to Tanzania or any other country en route to Tanzania, we cannot be held liable. If you are unable to enter the country for any reason, no refunds will be provided, and it will not be possible to reschedule the tour since all park fees and other expenses will have been paid in advance.

Accommodation

Accommodation in hotels Our prices for the open group departures include accommodation on a sharing basis in double or twin rooms with your fellow-traveler. If you travel alone, we will match you with a same-sex traveler to share a room. If you want to stay in your room alone, please inform our managers at the time of booking. Extra charges for single supplements apply. Accommodation type and setup for our private adventures are agreed with our consultants individually. Our safari and Kilimanjaro climbing tours include hotel accommodation described in the respective travel packages on our website. In some cases, however, those hotels may be fully booked. We will notify you and suggest an alternative hotel before confirming your tour and accepting payment. Tented accommodation on Mount Kilimanjaro Our Kilimanjaro climbing packages include tented accommodation on a sharing basis (2 travelers per tent). You will share a tent with your fellow-traveler. If you travel alone, we will match you with a same-sex traveler to share a tent. If you want to stay in a tent alone, please inform our managers at the time of booking. Extra charges for single supplements apply. Please note that tented accommodation on Marangu route of Mt Kilimanjaro and Mt Meru is not possible because of the park regulations.

Fitness and Medical information

Determining whether you are physically fit for a Kilimanjaro climb or a wildlife adventure and assessing your health conditions is solely your responsibility. However, upon request, our consultants may provide advice on this matter. We recommend seeking a qualified medical opinion if you are unsure. To ensure your safety and that of other tour participants, we may request that you provide specific medical information and complete our medical form. If you have a pre-existing medical condition that may impact your ability to visit mountainous or remote regions of Tanzania, we may require that the form be signed by a licensed medical practitioner. Failure to provide the medical form, or not having it signed by a licensed medical practitioner, may result in the cancellation of your tour, and applicable cancellation fees, as outlined in the cancellation clause of these Terms and Conditions. If we determine that your medical condition renders you unfit for participation, we reserve the right to decline your request to take part in our tours. This includes physical or mental disorders or illnesses that may put you or other participants in danger. All medical information provided to us will be treated in accordance with the “Treatment of Your Personal Information” clause of these Terms and Conditions. Your participation in our tours may be canceled without refunds in the following situations:

  • If we discover that the medical information provided to us is false, inaccurate or incomplete.
  • If, while taking part in our tour, your medical condition deteriorates to the extent that it puts yourself and/or other tour participants in danger.
You will need to cover any costs relating to the cancellation. If you have any special medical or dietary requirements, it is your responsibility to inform us in 30 days before your scheduled arrival in Tanzania. On our side, we shall spare no effort in trying to make sure that your special requirements are taken care of. Thus, for those following a special diet, we provide vegetarian, vegan, gluten-free and halal meal plans. Yet, you agree that we shall not be liable for any failure to attend to any other special needs. No refunds will be issued in such a case. You also agree that you have been sufficiently informed that some facilities and services, to which you may be accustomed in your country, may be currently unavailable or inaccessible in Tanzania.

Travel insurance

Having travel insurance is mandatory for participation in our trips. We may disqualify you from taking part in our adventure without any refunds if you do not have a proper insurance package. Remember that insurance is not generally included in our travel packages If you are climbing Mt Kilimanjaro, your insurance package should cover high-altitude trekking (up to 6,000 m/ 19858 f) and helicopter evacuation. You should also make sure that your insurance package provides sufficient coverage against all other relevant risks. It is also your responsibility to keep your insurance provider sufficiently informed of your travel plans and the nature of hazards and risks involved. If any insurance case happens, it will be your responsibility to inform your insurance provider and to comply with all procedures relating to indemnification/reimbursement. We shall provide reasonable assistance, but shall not be responsible for any positive outcome of the insurance claim whatsoever.

Vaccinations

Remember that we provide general, non-medical advice about vaccinations and immunizations, which are required or recommended for your visit to the United Republic of Tanzania. You should seek professional advice from a practicing, licensed physician to determine whether any specific medical measures are necessary for your visit to Tanzania.

Authority of our guides

It is important and mandatory to follow all safety instructions and rules of our guides. A chief guide’s decision on all expedition arrangements, team management, itinerary, objectives, and any other expedition-related matters while on Kilimanjaro trek will be final. If in the opinion of our chief guide, your physical condition or certain actions may be reasonably harmful or dangerous to yourself or other tour participants, the chief guide may decide that you should descend (his assistant and some porters will be helping you on the way).

You accept all risk of adventure travel to Tanzania

You understand that your adventures with us may involve visiting remote areas (National Parks, rural regions, etc.), where the standards of medical assistance may be different from those available in your home country or may be unavailable at all. In addition to that, you also acknowledge that some adventures offered by us may involve certain risks (for example wildlife, high-altitude, etc.) to your health and safety. You agree that you have carefully evaluated all of those risks and assume full responsibility for them. You release us from all claims and causes of action, which may arise from any losses, damages, injuries or death which may be the result of the risks inherent to your travels in Tanzania.

Your liability for damaged or destroyed property

We will charge you if you willfully destroy or damage our property, for example, our Kilimanjaro tents, safari vehicles, personal expeditions gear that you may hire from us, hotel furniture, items and appliances and so on. Any indemnification for damage or destruction should be settled in Tanzania, before your departure to the home country.

Our liability for accommodation providers and air carriers

Some parts of your tour will be subcontracted to the accommodation providers and local air carriers. Though we are highly selective in choosing our partners, we can not control their performance, which makes us unable to assume responsibility for your experience with them. In addition, you should remember that while you will be staying in the hotels and lodges, it is their terms and conditions that apply. Conditions of Carriage and applicable aviation conventions will govern your relationship with the airlines. Because of that we will not be assuming responsibility for any claims arising out of the performance of any parties other than our company and our employees.

Money for regular travel expenses

It is important to note that you will need to have a reasonable amount of money with you to cover any incidental and regular travel expenses, such as souvenirs, tips, meals (if not included), and alcoholic beverages. Please be aware that we will not be responsible for any failure on your part to cover these expenses for any reason. We strongly advise that you plan and budget accordingly to ensure that you have sufficient funds to cover these expenses during your trip. While we strive to provide the best possible experience for our customers, we cannot be held responsible for any unforeseen expenses that may arise during your travels. Therefore, we urge you to plan accordingly and ensure that you have enough funds to cover all incidental and regular travel expenses that may arise during your trip.

Equipment and gear for Kilimanjaro climbs

Though all group camping equipment is included in our Kilimanjaro packages, your personal outfit (mostly clothes for climbing) is not. Thus, you should bring all personal gear for your Kilimanjaro adventure. Our consultants will let you know what you will need for the expedition. If you do not have certain gear, you may hire everything necessary from us. However, remember that personal gear hire is not included in your tour price and extra fees apply. Before the start of your Mt Kilimanjaro or Mt Meru climbing tour, our wildlife consultant may ask you to provide your personal equipment for inspection.

Your luggage and valuables

We shall not be responsible for any luggage lost, destroyed or delayed by the airliner or any transportation provider other than our company. If you have purchased a trip to climb Kilimanjaro with us and your luggage is lost or delayed, and your climbing equipment was included in it, we will provide you with all necessary equipment from the rental shop for half the regular rental price. However, please note that we will only contribute half of the rental price for the items you had in your lost or delayed luggage. For any items that were not included in your lost or delayed luggage, normal rental prices will apply. In addition, neither are we responsible for being in touch with the airliner checking the status of your lost/delayed luggage, nor are we responsible for transporting it to the hotel after it arrives. If your luggage arrives later than you, you will need to pay a luggage delivery fee of transporting the luggage from Kilimanjaro International Airport to the hotel. You are responsible for keeping your valuables, such as money, gadgets, jewelry, and other personal possessions or luggage while taking part in our tours. We shall not be responsible for any lost, stolen or damaged property. You may ask our managers to accept your valuables, personal possessions or luggage for safekeeping. In such a case, we will lock them in our company safe. We will assume full responsibility for your property entrusted into our care.

Images and Marketing

As a participant in our tours, you understand and agree that our employees and other tour participants may take photos, videos, and other media images during the course of our adventures. These photos and videos may include images of you. By participating in our tours, you agree that we and our partners may use this media material for marketing, promotion, and advertising purposes, without any obligation to provide royalty payments or other compensation to you. If you do not wish to have your image captured by any photo or video cameras, please inform our staff accordingly. We value your privacy and will make every effort to respect your wishes in this regard.

Unforeseeable Circumstances

We cannot be held liable for any events that may occur due to unforeseeable circumstances, which may include natural disasters, war or military conflicts, mechanical failures, fires, vehicle or electrical malfunctions, civil unrest, labor strikes, government actions, political instability, uprisings, extreme weather conditions, or other unforeseeable and uncontrollable situations. These circumstances are beyond our reasonable control, and we could not have predicted their occurrence. Therefore, we cannot assume responsibility for any losses or damages resulting from such events.

Application of Tanzanian Laws

In the event of any disputes, the laws of the United Republic of Tanzania shall be applicable.
